This document refresh is intended to improve the clarity, consistency, accuracy, compliance with WA state regulations. Additionally, the only minor changes include:

    • Voting rights officially documented  as 1 vote per lot/unit
    • Member approval attending a meeting – majority of those present vs 67% of the community (enabling proxy or not)
    • CCRs
    • Bylaws – how the board/community votes to amend bylaws.
    • R&Rs – article 12 (5 pages long) and fines policy consolidated.

Governing Documents (Draft until community Approval)

The Kahler Glen Homeowners Association is a non-profit corporation registered with Washington State.  It is managed by a duly elected Board of Directors.  Its purpose is to govern the community in accordance with the provision of the legal documents: CC&R’s, Bylaws, and Article of Incorporation.  The corporation is financially supported by all members of the homeowner’s association.  Membership is both automatic and mandatory with every homeownership in Kahler Glen.  Elected directors are homeowners who volunteer their time to serve on the board.

CC&Rs
The Declaration of Covenants and Restrictions, otherwise known as the CC&Rs, are the governing legal documents that set up the guidelines for the operation of the planned community as a non-profit corporation.  The CC&Rs are recorded with Chelan County Records.  Failure to abide by the CC&Rs may result in a fine to a homeowner by the Association.

Bylaws
The Bylaws are the guidelines for the operation of the Kahler Glen Homeowners Association non-profit corporation.  The Bylaws define the Board of Directors, association membership, as well as other items necessary to run the Association as a business.

Article of Incorporation
The Article of Incorporation for Kahler Glen Community Association is filed with the office of the Secretary of State for Washington State. To obtain a copy of the original filing, submit a written request and the required fee to the Office of the Secretary of State.
